    Cancellation and Return Conditions

    **CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS**

    GENERAL:

    1. When you place an order electronically through the website you are using, you are considered to have accepted the preliminary information form provided to you and the distance sales contract.

    2. Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the purchased product.

    3. Shipping fees, which are the product shipping costs, will be paid by the buyers.

    4. Each purchased product will be delivered to the person and/or establishment at the address specified by the buyer, without exceeding the 30-day legal period. If the product is not delivered within this period, buyers may terminate the contract.

    5. The purchased product must be delivered complete and in accordance with the specifications listed in the order, along with any warranty certificates, user manuals, and similar documents.

    6. In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer of this situation in writing within 3 days of learning about it. The total amount must be refunded to the buyer within 14 days.

    IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

    7. If the buyer does not pay the price of the product purchased or cancels it in the bank records, the seller's obligation to deliver the product ceases.

    TRANSACTIONS MADE WITH THE UNAUTHORIZED USE OF A CREDIT CARD:

    8. After the product has been delivered, if it is determined that the credit card used by the buyer has been used fraudulently by unauthorized persons and the seller does not receive the sale price from the relevant bank or financial institution, the buyer is obliged to return the product to the seller within 3 days, with shipping costs borne by the seller.

    IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

    9. If unforeseen force majeure events occur and the product cannot be delivered on time, the buyer will be informed of the situation. The buyer may request to cancel the order, to change it to a similar product, or to postpone the delivery until the impediment is removed. If the buyer cancels the order; if payment was made in cash, the amount will be refunded in cash within 14 days from the cancellation. If the payment was made by credit card and canceled, the product price will be refunded to the bank within 14 days from the cancellation; however, it may take 2-3 weeks for the bank to transfer it to the buyer's account.

    BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

    10. The buyer shall inspect the goods/services subject to the contract before receiving them; they will not accept any damaged or defective goods/services such as those that are crushed, broken, or have torn packaging from the shipping company. It shall be assumed that the goods/services received are undamaged and intact. AFTER DELIVERY, the buyer must take good care of the goods/services. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.

    RIGHT OF WITHDRAWAL:

    11. The buyer may exercise the right of withdrawal from the contract without any legal or penal liability and without giving any reason, by rejecting the goods within 14 (fourteen) days from the delivery date to themselves or to the person/organization they indicated, by notifying the seller using the contact information below.

    DURATION OF THE RIGHT OF WITHDRAWAL:

    13. If the service purchased is a service, this 14-day period begins from the date of signing the contract. For service contracts where the performance has begun with the consent of the consumer before the withdrawal period ends, the right of withdrawal cannot be used.

    14. The costs arising from the exercise of the right of withdrawal are borne by the seller.

    15. It is required to notify the seller in writing through registered mail, fax, or email within the 14 (fourteen) day period to exercise the right of withdrawal, and the product must not have been used in accordance with the provisions regarding "Products for which the Right of Withdrawal Cannot be Used" in this contract.

    USE OF THE RIGHT OF WITHDRAWAL:

    16. The invoice for the product delivered to the third party or the buyer, (if the invoice of the product to be returned is institutional, it must be sent back along with the return invoice issued by the institution). Returns of orders invoiced on behalf of institutions cannot be completed unless an RETURN INVOICE is issued.

    17. The return form and the box, packaging, and any standard accessories of the products to be returned must be delivered completely and undamaged.

    RETURN CONDITIONS:

    18. The seller is obliged to refund the total amount and any debts incurred by the buyer to the buyer within a maximum of 10 days from the date the withdrawal notification reaches them, and to accept the product back within 20 days.

    19. If there is a decrease in the value of the goods for reasons arising from the buyer’s fault or if the return becomes impossible, the buyer is obliged to compensate the seller for the damages incurred in proportion to their fault. However, the buyer is not responsible for changes and damages occurring due to proper use of the goods or products during the right of withdrawal period.

    20. If the promotion limit established by the seller is breached due to the exercise of the right of withdrawal, the discounted amount utilized within the scope of the promotion will be canceled.

    PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

    21. Products prepared at the request of the buyer or clearly tailored to personal needs that are not suitable for return, including underwear items, swimsuits and bikini bottoms, cosmetics, single-use items, goods that may perish quickly or are likely to expire, items whose packaging has been opened by the buyer after delivery, which are unsuitable to return for health and hygiene reasons, products mixed with other products after delivery and those that cannot naturally be separated, goods related to periodic publications such as newspapers and magazines provided under a subscription agreement, services performed immediately in the electronic environment or intangible goods delivered to the consumer immediately, along with sound or visual recordings, books, digital content, software programs, data recording and storage devices, computer consumables and stationery items (toner, cartridges, ribbons, etc.) if the packaging has been opened by the buyer cannot be returned as per the regulation. Additionally, the exercise of the right of withdrawal for services that have begun to be performed with the consumer's consent before the end of the right of withdrawal period is also not permissible as per the regulation.

    22. Cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and tapes, and stationery consumables (toner, cartridges, ribbons, etc.) must be unopened, untested, undamaged, and unused to be eligible for return.

    DEFAULT AND LEGAL CONSEQUENCES:

    23. If the buyer defaults on payment transactions made by credit card, the buyer acknowledges, declares and undertakes to pay interest under the credit card agreement with the issuing bank and to be liable to the bank. In this case, the relevant bank may take legal action; it may request the arising expenses and attorney’s fees from the buyer, and under all circumstances, in case the buyer defaults due to their debt, the buyer agrees to pay the damages incurred by the seller due to the delayed performance of the debt.
